AIFMD 2.0 – Overviews of the key changes to be made

The text of a directive to amend the AIFMD, agreed between the European Parliament and Council of the EU in July 2023, is now working its way through the formal process of adoption.

The current expectation is that the text will be published in the Official Journal in Spring 2024 - its provisions will come into effect two years later.

The changes that the amending Directive will make are not as wide ranging as was once thought likely. Nevertheless, some are significant and AIFMs – both EU and non-EU - should familiarise themselves with them and assess their possible impact in good time.

The trilogue negotiations, which led to agreement on a final text, were dominated by a relatively small number of key issues.
