Aansprakelijkheid van arbiters

A question that comes up more often is the question of arbitrators’ liability. In a recent publication, Prof. Niek Peters and Jonathan Bakker have been discussing the liability of arbitrators from a Dutch perspective. In this publication Prof. Peters and Mr Bakker have set out the relevant test for liability, whether the annulment of the award is required for liability, the legal basis of liability (i.e. contract and/or tort), the possible limitation of liability and some questions of private international law.
