Working with Monzo since it was a rising Fintech star, we continue to support its rapid growth from leading challenger bank to international smartbank. We have helped Monzo grow its brand and IP portfolio, reacting quickly to its hyper growth and dealing swiftly and efficiently with the many challenges faced by consumer brands.
Our client was keen to see a competitor’s trade mark registrations cancelled on the grounds of lack of distinctiveness. We took over this action at appeal, after the client lost the case at first instance as a result of overwhelmingly unfavourable survey evidence produced by the defendant. It was a challenging case to argue as the registrations were in English and the French courts are often reluctant to attribute a detailed knowledge of English to the French public. We successfully demonstrated that the survey evidence was biased and had misled the first instance court into applying the test of distinctiveness incorrectly – the registrations were cancelled.
Acting for this Chinese fin tech and Unicorn, we were prosecuting and defending the companies trade mark portfolios in Hong Kong, the UK and EU27. Also assisting in global trade mark prosecution and enforcement.
