The impact of the CMA’s new enforcement powers on ESG

The Queen’s speech on 10 May 2022 confirmed the UK government’s proposed sweeping reforms to the UK’s consumer protection rules. Those reforms include new powers for the Competition Markets Authority (CMA) to impose large fines and other consumer compensation measures where they consider that a business has breached consumer protection rules. In this podcast, we explore the impact of those reforms on ESG issues, being an area that the CMA has become increasingly active in given its scope crosses consumer and competition law issues alike.

Court orders UK Government to publish revised net-zero policies report

On the same day as temperatures in the UK reach record-setting highs, the High Court ruled that the UK Government’s plan to reduce greenhouse gas emissions to net zero is too vague and therefore unlawful. As a result, the UK government has been ordered to published a revised net zero policies report by the end of March 2023. In this podcast, we take a closer look at the judicial review challenge brought by environmental campaign groups Client Earth, Friends of the Earth, the Good Law Project and environmental campaigner Jo Wheatley. We discuss the grounds of challenge brought, what arguments were accepted by the Court and how the decision plays into a wider trend we are seeking of the judiciary across Europe enforcing climate legislation with greater teeth.
