ESMA publish Final Report on Sustainability Risks
ESMA publishes Final Report following its CSA on sustainability-related disclosures and the integration of sustainability risks in the investment funds sector.
In an era of rising ESG expectations, from climate change to biodiversity loss and heightened scrutiny of supply chains and corporate purpose, businesses must adapt to thrive. Those who embrace this challenge are likely to unlock substantial benefits. In contrast, those who don't may find themselves entangled in civil litigation and heightened regulatory scrutiny.
ESG risk is a concern that transcends industries, yet its implications are diverse. Thus, every business must diligently uncover and manage its unique ESG risks. This encompasses maintaining compliance with legal obligations and addressing both commercial pressures and reputational vulnerabilities.
Our primary objective is to help clients steer clear of litigation whenever possible. Our proactive approach aims at identifying and addressing ESG risks before they escalate, thus empowering clients to enhance their reputation, attract sustainable investments, boost operational efficiencies, and ensure long-term success, all in a responsible and compliant manner.
Our services include:
We advise clients on avoiding costly litigation due to ESG mismanagement by implementing robust risk management protocols and ensuring regulatory compliance.
Our partnership with clients extends beyond ESG risk identification. In times of adversity, we stand firmly by their side, offering robust legal defence and unwavering support to protect their interests.
Our expert guidance and representation ensure compliance with evolving ESG regulations, deftly navigating any enforcement actions or investigations.
We scrutinise clients' existing risk policies, procedures, and processes to assess their compliance with ESG regulations and standards, identifying and addressing any gaps.
We support financial institutions, asset managers, and corporations in mapping out ESG legal risks in their supply chains. This includes analysing supplier contracts and devising strategies to mitigate these risks.
Our team assists in investigations and remediation efforts, minimising reputational damage and legal exposure. This expertise encompasses negotiations with stakeholders and regulators.
By addressing these critical areas, we empower clients to implement robust risk management protocols, ensure regulatory compliance, and proactively manage ESG risks throughout their operations.
Furthermore, our team raises awareness about ESG risks and provides upskilling support to clients' teams, enabling them to effectively manage potential risks.
