AIFMD 2 gets closer as EP approves changes

In a significant step towards the AIFMD amendments coming into force , the EP has approved the agreement reached with the Council in October 2023.

On 7 February 2024, a plenary session of the European Parliament (EP) approved the political agreement making changes to the AIFMD, which was reached between the EP and the Council of the EU (Council) in October 2023.

This is one of a number of steps - albeit a significant one - that need to be taken before the changes come into effect.

What happens next?

  • The Council is expected to endorse the political agreement at a meeting of its Economic and Financial Affairs Council (ECOFIN) due to be held on 12 March 2024.
  • The text is then expected to be published in the Official Gazette in April 2024.
  • Its provisions formally 'enter into force' on the twentieth day after publication.
  • Member States will have 24 months from entry into force in which to transpose the new rules into their national law.
  • Provided the above timing doesn't slip, the new rules would come into effect in April 2026.
