ESG: the CDA on gas and nuclear activities is published in the OJ
The European Commission’s Complementary Delegated Act on natural gas and nuclear activities completes its legislative journey.
We have published a number of articles this year, following the unusually eventful path of the European Commission’s proposals for a Complementary Delegated Act (CDA) under the Taxonomy Regulation.
The CDA classifies certain fossil gas and nuclear energy activities as transitional activities which contribute to climate change mitigation under the Taxonomy Regulation. The inclusion of certain gas and nuclear activities would be time-limited and dependent on specific conditions and transparency requirements.
Last week we reported that the European Parliament had voted to accept the draft wording (albeit by no means unanimously).
We can now confirm that the CDA has been published in the Official Journal.
Its provisions will apply from 1 January 2023, as originally envisaged.
