Supreme Court judgment: URS Corporation Ltd v BDW Trading Ltd

The Supreme Court will hand down its judgment in URS v BDW on 21 May, following a hearing in December 2024. Amongst other things, we expect the court to address:

1. The application of the retrospective extension to limitation periods provided for under s135 of the Building Safety Act to other claims (i.e. those in negligence); and

2. The scope of Section 1(1) of the Defective Premises Act; in particular whether it applies only to purchasers of property, or more widely also to developers; and

3. recoverability of losses incurred without a legal obligation.

This judgment is likely to have significant impacts for those in the building safety world. We will digest the judgment and share our findings and thoughts with you on at 10am on Friday 23 May.
