We recently held our breakfast briefing webinar focused on the latest developments relating to cross-border provision of regulated services in Germany and the Netherlands.

The landscape for the provision of regulated activities across Europe is changing. Post Brexit the discussion has reached new momentum with the understanding of “equivalence” as a precondition for EU market access reaching a new stage. ESMA and EBA have published various papers regarding the requirements which have to be met before being allowed to provide regulated services in an EU country.

The session sets out the latest regulatory developments in the two EU countries and consider the ongoing ESMA consultation regarding technical standards on the provision of investment services and activities in the EU by third-country firms under MiFID II and MiFIR. We shed light on the current interpretation of outsourcing, which is one way of carrying out sales activities in the EU, and provide an overview of the main supervisory focus of the German and the Dutch regulator in 2020.
