The proposed new Product Liability Directive, along with the now in force Representative Actions Directive, both promote consumer interest. Producers and others in the supply chain will face increased unitary and collective claims for product defect, with increased prospects of success for claimants. In tandem, regulatory scrutiny is likely to increase due to the enhanced product safety regime arising from the General Product Safety Regulation, in force in the EU from December 2024. High profile regulatory action fuels civil claims, and civil claims fuel regulatory action, leading to a momentum against producers and other economic operators.
