Protection of knowhow and (un)fair competition

The war for talent inevitably results in more job-hopping. Companies are faced with employees obtaining knowhow of the company while there is an increasing risk that these employees can leave the company at any time and, in the worst case scenario, join a competitor. Businesses are rightly concerned about the protection of the know-how they have carefully built up.

In this session, we elaborate on the protective measures companies can take to safeguard their knowhow and to mitigate the risk of being faced with detrimental competing activities. Furthermore, we explain the different actions companies can take when being faced by different acts of competition from their former employees and collaborators.

Flexible working arrangements

The COVID-19 pandemic has changed the mindset of employees on the way and the framework wherein they are working. In order to engage and retain talented professionals, companies will have to anticipate to these changing views and have to provide a working organisation wherein employees, among others, enjoy the necessary freedom and flexibility to perform their work.

In this session, we elaborate on the different possibilities to navigate through the sometimes rather rigid legal framework in order to organize the work as flexible as possible. For each possibility, we will focus on finding the balance between the wishes and desires of employees and the preservation of the interests and priorities of companies.

Engaging third parties

The shortage on A-talent employees also implies that companies are sometimes condemned to engage third parties to support their activities. Different forms of engaging third parties are possible (contractors, service companies, temp employees) with each possibility having its specific traits and attention points.

In this session, we elaborate on the necessary points and best practices companies should take into account when contracting and working with third parties
