Here's a quick update on the latest status of the RIS trilogues. As we reported in our May alert, following the first trilogues taking place in May, the Commission issued its simplification proposals to the Parliament and Council in May. The original plan was for second trilogues to take place on 3 June.

What's happened since...

In mid-May, the Parliament and Council respectively discussed those Commission simplification proposals - the general consensus was that the Commission had not gone far enough on simplification. The Parliament (under rapporteur MEP Yon-Courtin) subsequently also set out its own simplification proposals which it described as an "add-on" to those of the Commission.

However any further progression was stalled recently with the Council's Polish Presidency confirming that it would put RIS on hold for the remainder of its tenure, which ends on 30 June. This was not unexpected, given the Polish Presidency's previous suggestions that it did not intend to prioritise RIS under its tenure, but it does mean that no second trilogue took place on 3 June.

What's next?

In contrast to the Council's Polish Presidency, the Danish Presidency (which will take over on 1 July) appears very keen to progress the RIS file. So much so that it has apparently tabled the second trilogue to take place at 9am, 1 July (the first day of its Council Presidency). Significantly we understand that the Parliament is optimistic to take the file forward with the Council on this basis.

Is there a risk RIS will be withdrawn entirely?

We don't think so. Whilst the Commission made various threats last year to withdraw RIS in its entirety (accusing the Parliament and Council of 'watering down' the proposals), we've heard that there is a real appetite amongst a majority of Member States to move forward with RIS, in a simplified form (whatever that may look like). Indeed, with the recent optimism expressed by the Parliament and Council (under the Danish Presidency), at this stage we could see RIS fully (or significantly) progressed in H2 2025.
