The fulfilment of the climate commitments set by the Spanish Government for the coming years depends, to a large extent, on a rapid deployment of energy production technologies from renewable sources, which, in turn, makes it necessary to adapt and update the instruments aimed at promoting private investment in these technologies.
Among these instruments is the economic regime for renewable energies (“REER”) which, approved in November 2020 on the basis of the provisions of section 7 bis of article 14 of Law 24/2013, of 26 December, on the Electricity Sector (hereinafter, “LSC”), constitutes an additional or alternative regime to the specific remuneration regime (“RRE”).
The need to review the regulatory framework of the REER has arisen almost four years after its initial approval. The aim of this review is to adapt the framework to recent developments in the electricity system and to the energy and industrial policy objectives adopted at European level. The adjustments also stem from the experience gained in the auctions held to date within the framework of the REER.
By amending the REER, the aim is to improve the design of the auctions in three main areas:
- The inclusion of non-economic award criteria (such as socio-economic benefits, sustainability, innovation, etc.).
- Contribute to greater system flexibility, facilitating the integration of the energy generated by the projects awarded in future auctions at the times when it is most necessary for the electricity system.
- Introduce improvements in the design and procedure of auctions and the associated economic regime.
In this context, on 5 April 2024, the Government opened a prior public consultation to gather the contributions or comments that any interested person, entity or organisation may wish to provide in relation to the revision process of the REER. To this end, they may submit regulatory and non-regulatory proposals on the above points.
