A high level outline of employment protection for whistleblowers in Hong Kong.

Introduction

In Hong Kong, unlike the UK, there is no specific legislation which protects an individual who blows the whistle on his/her employer or others.

Whistleblowing policies/arrangements

There is also no legal requirement in Hong Kong for an employer to adopt or implement a whistleblowing policy.  Listed companies, however, are encouraged to do so under the Code on Corporate Governance Practices in the Main Board Listing Rules.  It may also be advisable for companies to adopt such procedures in order to ensure that any concerns that individuals may have are brought to the company’s attention before being raised externally.
