Landmark ruling: Government obtains “remediation order” against property freeholder

The First Tier Property Tribunal issued its first judgment in which the Government (via the Secretary of State for Levelling Up, Housing and Communities) succeeded in obtaining a Remediation Order against a landlord under Building Safety Act 2022. The judgment is Secretary of State for Levelling Up, Housing and Communities -v- Grey GR Limited Partnership.

This judgment involves an order which requires the landlord to take steps to complete (currently ongoing) remedial works by a certain date; but will be of interest as it raises issues about the nature of Remediation Orders (which are a no-fault based remedy) in the context of direct Government action; building safety funding; and other issues.
