New rules have been approved which make fundamental changes to how lawyers must interview witnesses and draft their witness statements.
These changes apply to any trial witness statement in the Business & Property Courts to be signed on or after 1 April 2021. Practitioners, however, must be aware of the changes for both new and live cases.
Strict requirements on the witness interview process will be imposed, and a new requirement to certify compliance with the rules introduced.
The impacts of these changes have already been felt, with our team having been involved in proceedings where the new rules (in draft) were used to make applications attacking witness statements for non-compliance.
