When private prosecutions interact with civil proceedings

It is not unusual, particularly in economic crime cases, for a private prosecution to be brought or threatened in circumstances where civil proceedings relating to the same or similar facts are anticipated or ongoing. Many of the issues that arise apply equally where criminal proceedings are brought by the state, but there are a number of specific considerations where a prosecution running concurrently with civil proceedings is brought by a private company or individual, which those bringing or defending a prosecution should be aware of. These considerations are particularly important as a failure to appreciate them at an early stage could seriously undermine the prosecution’s prospects of success and/or lead to criticism of the way in which the action has been brought.
