Adjust your contracts for services now: abolition of the VAR is a fact

VAR will cease to exist on 01 May 2016

The implementation of the Assessment of Employment Relationships (Deregulation) Act (Wet Deregulering Beoordeling Arbeidsrelaties) means that on 01 May 2016 the Declaration of Independent Contractor Status (Verklaring Arbeidsrelatie: "VAR") will cease to exist. From that date, clients of independent contractors will no longer be protected by the exemptions afforded by the VAR. As a consequence thereof, each individual work relation with a contractor will have to be assessed to determine whether there is an obligation to withhold payroll taxes or whether there is a genuine client-contractor relationship.
