Watch our webinar on demand where we focussed on the detail of the recently finalised and published Executive Order to Implement the European Union-U.S. Data Privacy Framework. Alongside US law experts from Wiley Rein LLP we looked at the detail of that arrangement and what it means for transfers of personal data from the EU and the UK to the US. We also covered the impact of the new arrangements on US authority powers to access data and conduct surveillance.

The EU-US Data Privacy Framework replaces the Privacy Shield and will help restore the legal basis for transatlantic data flows that enable the $7.1 trillion EU-US economic relationship. The EU-US Data Privacy Framework provides additional privacy safeguards by building in a proportionality and necessity test and creates an independent binding redress mechanism. The new framework is intended to provide the European Commission with the basis for an adequacy decision under EU law and will also provide greater legal certainty for companies using Standard Contractual Clauses or Binding Corporate Rules to transfer EU personal data to the United States.
