Last June, the pre-proposal in respect of the modernisation of our NV laws has been presented and this September, the act in respect of the UBO Register will become effective. The WHOA - a Dutch scheme of arrangement

Recently the Dutch Act on Court Confirmation of Extrajudicial Restructuring Plans (CERP; Wet homologatie onderhands akkoord, or WHOA in Dutch) was approved by Dutch Parliament. The WHOA introduces the possibility of a debt restructuring plan outside formal bankruptcy proceedings (a scheme of arrangement) with creditors and shareholders. During this webinar we discuss insolvency and pre-insolvency considerations including the key elements of the WHOA.
