The WHOA - a Dutch scheme of arrangement

Recently the Dutch Act on Court Confirmation of Extrajudicial Restructuring Plans (CERP; Wet homologatie onderhands akkoord, or WHOA in Dutch) was approved by Dutch Parliament. The WHOA introduces the possibility of a debt restructuring plan outside formal bankruptcy proceedings (a scheme of arrangement) with creditors and shareholders.
