General Experience

Sarah specialises in soft IP and is responsible for the day to day running of the Paris Intellectual Property Department which is recommended by Chambers Global, Managing Intellectual Property under the categories “Trade Mark Contentious” and “Prosecution”, as well as World Trademark Review, Décideurs and Option Droit et Affaires.

She advises on all the aspects involved in the creation, exploitation and protection of trademarks, design rights, copyrights and domain names and is also well versed on the issues relating to unfair competition, dealing with both contentious and non-contentious matters. Sarah also deals with data protection and advertising matters.

Sarah Bailey was noted by Chambers Global as being able to “explain the cultural and practical differences for general prosecution work in filing and trade marks [..] as well as being commercial and grasping the priorities of a business”. WTR also noted the team’s “speed and efficiency without losing quality, making them a great choice of firm” and that Sarah “thinks outside the box and can construct innovative strategies that aren’t bogged down routine or tradition. Recent Work
  • defending an international pharmaceutical company in an appeal to the General Court of the Court of Justice of the European Union in the context of opposition proceedings
  • defending an international pharmaceutical company in a claim by a retired employee for supplementary remuneration in respect of various patents – currently in front of the Paris High Court
  • defending a major international cosmetic company in proceedings in front of the Paris High Court in relation to a copyright and design right infringement claims, which raised significant issues regarding the court’s pan-European jurisdiction in the case
  • conducting regular clearance searches, and advising, major international consumer product businesses on the launch of new product ranges
  • assisting a niche luxury cosmetic company following the European launch of a new range of cosmetics by a significant competitor whose trade dress came too close the distinctive presentation associated with the niche brand; successfully settling the matter across Europe
  • advising on the copyright ownership issues in the employment context
  • defending a major international brand in a claim of trade mark infringement and unfair/parasitic competition by a high profile Parisian Fashion brand. Leading settlement negotiations to a commercially acceptable solution for both sides
  • negotiation of license arrangements in the context of opposition and infringement proceedings initiated by our client, in coordination with the Brands team in London.

Sarah is a French qualified lawyer as well as a solicitor of the Supreme Court of England and Wales. She holds a Certificate in Intellectual Property (trademarks, designs and models) from the Centre Robert Schumann of the University of Strasbourg. Sarah joined Simmons & Simmons in London in 1990 and moved to the Paris office in September 1991, she became a partner in 2016.

Membership of Professional Bodies
Sarah is an active member of INTA, and the French Trademark association APRAM, and sits on the Regulatory Committee for MARQUES. She regularly speaks at conferences held by these organisations.
