General Experience

Peter is a partner in the firm's EU, competition & regulatory group. He has broad experience of advising clients on competition law and merger control issues.

He advises a wide range of technology, financial services, energy and infrastsructure, industrial and consumer clients. He regularly provides advice on the competition law issues arising from mergers, acquisitions and structural joint ventures, and also has considerable experience dealing with non-structural joint ventures and cooperation agreements. His practice also covers behavioural competition law, including abuse of dominance, and he has been involved in assisting clients in cartel investigations, as well as advising them how to avoid cartel liability and ensure compliance with competition law.

Peter is contributing editor to “Telecoms and Media”, published by Getting The Deal Through.

Peter has also published the European Union law section in Global Legal Insights to: Merger Control 5th-7th Edition.

Recent Work
  • representing various clients in investigatory proceedings in front of the European Commission, the CMA and the FCA 
  • advising clients in the CMA’s market investigation into investment consultants and the CMA’s market study into statutory audit 
  • acting head of competition at O2 for 12 months 
  • advising a Chinese communications company on a possible EU complaint against a competitor 
  • advising Orkla ASA on the competition law issues raised by the creation, together with Norsk Hydro ASA, of the largest soft-alloy alumnium extrusion joint venture in the world. This involved notifying the transaction in a number of different jurisdictions, including the European Comission, which cleared the deal subject to remedies 
  • advising ED&F Man in relation to its strategic alliance with Südzucker in which Südzucker acquired a 24.9% stake of ED&F Man. This transaction was subject to a Phase II investigation by the European Commission and was ultimately cleared with commitments 
  • advising Schlumberger Limited on a number of different matters, both behavioural and transactional, including on the merger control and related competition law aspects of its $12 billion acquisition of Smith International, Inc, a competing oilfield services supplier. This required clearance from the European Commission and also involved managing merger filings in other jurisdictions 
  • advising Kier in relation to a Competition Act 1998 cartel investigation, including a subsequent successful appeal to the Competition Appeal Tribunal against the Office of Fair Trading’s decision in which Kier's fine was reduced by over 90% 
  • advising various financial institutions on competition law issues relating to the creation of platforms and trade discussion bodies, including the risks of potential information exchange and exclusion of competitors
Background

Peter became a partner in the Simmons & Simmons’ EU, competition & regulatory practice in 2013, having trained with the firm. He writes regularly on competition law and also speaks on the subject, both at public conferences and at internally-organised client-focused events.

Peter has spent time on secondment to the UK competition law authority, giving him a unique and valuable insight into the perspective of the enforcer.

Peter is England & Wales and Brussels qualified.

In addition to English, Peter speaks French, Italian, Spanish, Portuguese and some German.
