General Experience

Benedikt advises on all aspects of asset management, regulated and unregulated funds, private equity, general M&A and corporate law. He focuses on advising both investors and fund sponsors on the structuring and formation of investment funds, including private equity, real estate, infrastructure, mezzanine and hedge funds. His practice covers related tax and regulatory matters in all relevant fund jurisdictions.

Benedikt has particular experience with accompanying investments of German insurance companies and other regulated investors. He has in-depth knowledge of structuring and implementing fund-of-fund and multiple-tier structures, fund-platforms for indirect investments, and tax efficient structured products.

Recent Work
  • advising one of the largest secondary transactions for a Swiss family office involving the transfer of 48 interests in target funds to a private equity fund of fund investor
  • advising on the restructuring of the holding of a portfolio of securities worth over 100bn Euro. The securities were directly held by life insurance companies within a leading French multinational insurance and subsequently transferred into a series of German investment partnerships for a long term indirect holding with favourable insurance regulatory and balance sheet effects
  • advising on the structuring and implementation of a private equity and real estate fund platform in Luxembourg for a major New York based asset manager for private equity and private equity real estate. This involved the establishment of a series of four parallel fund structures. Two are SICAV-SIFs and two are unregulated funds.
Background

Prior to joining Simmons & Simmons he worked for major international law firms in Frankfurt, with an extended assignment to one firm’s London office.

After studying law at the Universities of Hamburg and Bremen, Benedikt qualified as a Rechtsanwalt (German lawyer) in 1997.

Benedikt has been recognised in independent directories, including Chambers Europe, The Legal 500 and JUVE, recognize as a valued and established figure for investment funds and regulatory matters. He is recognised as leading lawyer in the Best Lawyers in Germany 2017 and 2018 list published by the German nationwide daily Handelsblatt for the area Investment Funds and in 2018 was again named best lawyer. Chambers Europe 2017 quotes clients who say he "is responsive and gives good advice". Who’s Who Legal 2015 features him in the area of Private Funds in Germany and The Legal 500 Deutschland 2014 recognized him as "highly recommendable." In its 2012 edition, Chambers Europe noted that "he is highly experienced in investment management, regulated and unregulated funds, and all related regulatory issues. Interviewees regard him as a ‘very effective and experienced adviser, who excels at translating the letter of the law into practical business terms."
